Terms of Service

Quetzal is operated by Quetzal Tech, S.L. (Sociedad Unipersonal), a company incorporated in Spain with registered office at Alameda Principal, 24, planta 1ª, puerta 3, 29005 Málaga, España. Full company identification is in the Legal Notice. These terms form the agreement between you and that company.

Quetzal is offered as an early-access product. Features may change, and some platform integrations depend on third-party app reviews (for example, Meta App Review or TikTok API audits) that can limit visibility of published content until approved. We surface those states honestly in the product and never report a post as public until it actually is.

You are responsible for your account credentials and for everything published through your workspace. Keep your login secure and tell us immediately at hello@quetzaltech.es if you suspect unauthorized access.

You own what you bring and what you make. The briefs, assets and brand materials you provide remain yours, and the content Quetzal generates for you — captions, drafts, visuals — belongs to you once generated. We claim no rights over your published work. You grant us only the limited license needed to operate the service: storing, processing and publishing your content on your instruction.

You agree not to use Quetzal to create or distribute unlawful, deceptive or harmful content, and to respect the terms of service of every platform you connect. Quetzal enforces its own safety filters; content that fails them is not published. We may suspend accounts that abuse the service or the platforms it publishes to.

Publishing to Instagram, Facebook, LinkedIn, TikTok, X or YouTube happens under your own account and remains subject to that platform’s own terms and policies, which you must comply with independently of these terms. Where we act through Meta’s APIs, your use is additionally subject to the Meta Platform Terms and Community Standards; equivalent rules apply for each other platform.

The platforms control their own services. They may remove content, restrict accounts, change or withdraw API access, or delay publication for their own review, and they can do so without notice to us. We are not responsible for those decisions, though we report them to you accurately when we learn of them.

By default, Quetzal publishes nothing without your explicit approval: drafts wait in your queue until you approve, edit or reject them.

You may also enable autopilot, which is an advance authorisation you give deliberately in your workspace settings. In review mode, the autopilot prepares everything and still stops for your approval. In full mode, you instruct us to publish on your behalf without approving each item individually, within the guidelines you configure. Full mode means posts go out under your name without a per-post review by you — that is its purpose, and turning it on is your decision. You can change the mode or switch it off at any time, and doing so takes effect on everything not yet published.

Paid plans are billed monthly or annually. Annual plans are paid upfront at a discounted rate; monthly plans can be cancelled any month, effective immediately. All prices are stated exclusive of VAT and any other applicable taxes; where tax applies, it is added at checkout at the rate in force. If you subscribe during early access, your price is locked in for as long as your subscription stays active, even as public pricing changes. Usage-based enterprise plans are governed by their individual contracts.

If you contract with us as a consumer resident in the European Union, you have 14 days to withdraw from the contract without giving a reason. Because Quetzal is a digital service supplied immediately, by starting to use it within that period you expressly request immediate performance and acknowledge that you lose the right of withdrawal once the service has been fully supplied. To withdraw, write to hello@quetzaltech.es. Business customers do not have a right of withdrawal.

The service is provided as is during early access. To the maximum extent permitted by law, Quetzal is not liable for indirect or consequential damages, for actions taken by the social platforms (including content removal, account restrictions or API changes), or for lost profits. Our total liability is limited to the amounts you paid us in the twelve months before the claim. Nothing in these terms excludes liability that cannot be excluded by law, including liability for fraud, for death or personal injury caused by negligence, or a consumer’s statutory rights.

You may stop using Quetzal and delete your workspace at any time; deletion removes your posts, connections and analytics, as described under data deletion. We may terminate accounts that violate these terms, with notice where reasonably possible. Sections on content ownership and liability survive termination.

We may update these terms as the service changes. For material changes we tell you before they take effect and ask you to accept the new version the next time you sign in. Continuing to use Quetzal after that point means you accept the updated terms.

These terms are governed by Spanish law. Any dispute is subject to the courts of Málaga, Spain. If you contract as a consumer, this does not deprive you of the protection of mandatory rules of the country where you live, and you may bring proceedings before the courts of your own domicile. Consumers in the EU may also use the European Commission’s online dispute resolution platform.
